Due to the Holiday, the Court is closed today, but I will be looking for the FDA's filing of its Notice of Appeal.

On another note, I do not know if it was posted that on Friday, the Docket showed that Judge Leon entered into the Record and Docketed the Amicus curiae Briefs filed by ASH and Alliance.

How long do they have to appeal?

Riddle--The FDA has 30 days from the date the ruling was docketed to file their Notice of Appeal. That would be Febuary 15, 2010.

Your previous post indicated the FDA had 20 days to file, and the cutoff would be Feb. 3. Your last post says Feb 15. Has something changed, or is this a typo?

Anyway, I'm expecting them to appeal at the last minute.

Jim--It is different in that particular Court--some are only 20 days, but the D.C. Federal Court is 30 days of an Interlocatory Appeal.
