Here is Arnold's response to SB400.

To the Members of the California State Senate:
I am returning Senate Bill 400 without my signature.
While I support restricting access of electronic cigarettes to children under the age of 18, I cannot sign a measure that also declares them a federally regulated drug when the matter is currently being decided through pending litigation.
Items defined as “tobacco products” are legal for anyone over the age of 18. If adults want to purchase and consume these products with an understanding of the associated health risks, they should be able to do so unless and until federal law changes the legal status of these tobacco products.
For this reason, I am unable to sign this bill.

Exactly Royal--he references the "pending litigation" and deferred. Does not speak well at this point for Judge Leon to allow all these different attacks by way of injuctions and use bans such as up in New Jersey this week, and still not release his ruling.

Today was advanced a Complaint filed by the Cal AG's office today. It seems many local and state jurisdictions are getting on board for some type of ban. Such a shame.

I haven't the time at the moment to read the whole thing, I wil tomorrow. But at first glance it reads a lot like more of the same old rhetoric spewed by ASH.

I just hope these courts don't attempt to legislate, but rather interprete and apply the laws as they are currently written.

That would be nice Jim, but the priorities are so askew these days that they do not know which end is up. Damn shame is what it is for us.
