A bill to prevent tobacco smuggling, to ensure the collection of all tobacco taxes, and for other purposes.
S.1147: PACT act passed on Mar 11, 2010: This bill
passed in the
Senate by Unanimous Consent. A record of each senator’s position was not kept.
Mar 17, 2010: This bill
passed in the
House of Representatives by roll call vote. The vote was held under a suspension of the rules to cut debate short and pass the bill, needing a two-thirds majority. This usually occurs for non-controversial legislation. The totals were 387 Ayes, 25 Nays, 18 Present/Not Voting.
This bill becomes law and goes in to effect on June 30th. What this means is that we will no longer be able to order any tobacco product online or by U.S. Mail, UPS, Fedex or any other means. It is just another way to insure we are being taxed. But what is weird is, from what I have surmised, Cigars are exempt from this bill. So why is that? Is it because some of our Congressmen and Senators are Cigar smokers and like to order them fresh?
So we have to ask ourselves what will this mean to our beloved e-cigs?
The way I see it, they will now declare e-cigs a tobacco product and then they will ammend this law to include e-cigs, and therefore will be illegal to sell or buy via the internet, mail order or any other means other than off the shelf at a store by this PACT act. And with many states who are already banning the sale of e-cigs from the typical brick and mortar stores, there will be no way for many of us to buy e-cigs legally even if they are not a banned product.
Some more food for thought. If e-cigs are declared a tobacco product, then Suppliers will be required to obtain a tobacco license, and collect taxes on them. I would then think they will make e-lquid illegal and require us to buy prefilled carts. Remember one cart equals a pack of smokes acording to a lot of suppliers, this we all know is wrong. But the Government will use this as a method of calucating taxes and we will then be seeing prefilled carts costing between $4.00 and $10.00 per cart, depending on where you live. Plus you will have to find a brick and mortar store that can legally sell them.
Just remember, come this November a lot of these people who gave us Government run health care, and now the PACT act are up for re-election. So this November it is time to clean house. Then we clean out the rest in 2012.
