Yes, you have already pointed this out. Reporters a lot of times take certain liberties if you will and spin the story with other points of view. As with a lot of these Reporters/Writers, they are in most cases working with a deadline and it sometimes shows like it does here for example.

For those of us who are more in the know, it is obvious this is out of date, as the Honorable Judge Leon announced his ruling more than a month ago.
